How Will Filing Bankruptcy Help Me?

I’m often asked, “How will filing bankruptcy help me?”
When I get this question, I want to take off my bankruptcy lawyer hat and just put on my “it’s just Dan hat.” Sometimes after practicing bankruptcy law for over 34 years my default answer is the technical response to the question.
Here’s my “Dan will Help” answer:
1. I give you your life back.
I understand what you are going through. You still get up and go to work every day. However, its likely that you’ve lost the joy of going to work simply because you are no longer working to provide for your family, but instead to get the heat off from the constant demands of creditors. I will make them STOP!
2. Your mailbox will no longer be filed with hateful letters from collection companies and their lawyers.
Yes, you’ll continue to get junk mail, but I really can’t stop that. When the holidays arrive you’ve have plenty of room for those cards from the special people in your life.
3. You can go ahead and do that repair to your house, because we’ve saved it from the foreclosure that was on the horizon.
When creditors threaten to foreclose your home, they are taking more than just real estate from you. This is your refuge, the place you have quality time with your family and your children. The creditors just look at it as a way for them to collect. Most of our clients save their home from foreclosure by filing a Chapter 7 case or by filing a Chapter 13 bankruptcy and curing significant defaults over time. You’ll get a great relief by just knowing that the kids will be going to the same school next year as they are now.
4. You now get to sleep at night. You can quit watching the ads on TV that suggest that if you buy this pillow or that pillow, you’ll have a good night’s sleep.
We both know that until you stop the threats from creditors, stop the collection lawsuits and stop the threats to repossess your car, you’re not going to sleep like the proverbial baby.
