So here’s the choice, bow down to the new Federal Health Care law or be saddled with all health care costs until you leave this planet.
Is that a reasonable option? Oregon’s Representative Peter Defazio believes that it is.
Just this week Representative Defazio floated the idea that one way around the recent court decision that struck down Obama’s Health Care law in its entirely because it requires every adult in America to buy health insurance or be fined. The court concluded that the mandate to purchase insurance is a penalty on doing nothing (non-activity) and was an impermissible expansion of the “commerce clause” so it is unconstitutional.
Defazio’s answer, proposed in less than one week, is to require you to waive any bankruptcy discharge for life unless you “opt” back in and then pay insurance premiums for 5 years.
Already one of the big motivating factors that force people to select bankruptcy is significant medical bills. This is true even for those that have insurance, but end up with significant medical bills. So Defazio’s idea, if adopted, will create to levels of people. Those who were obedient and purchased insurance and those who “just said no” and will be saddled with all their medical expenses. Catalog this idea under the heading, “When I tell you to do something, do it, or I’ll just come back with a more onerous idea.”
